TERMS OF USE, WARRANTY & LIABILITY WAIVER

Sandbox Marketing, Inc., 1137 W. Katella Ave. Orange, CA 92867 (herein “DeskGuard”) offers its products with the terms, conditions and notices as follows: 

Terms of Use

This product is offered to you conditioned upon your acceptance without modification of the terms, conditions and notices obtained. 

Exclusive Obligation

This product may not be used for unlawful purposes and that use is expressly prohibited under the terms and conditions of its use.

Use Limitation

You may not modify, copy or reproduce this product. DeskGuard Personal Protection Devices are designed for desk or table use only. Products may have sharp edges and points. Contact may result in injury. Handle with care. Custom Personal Protection Devices may vary in use. 

One Year Warranty

This product is warranted against any defective material or workmanship for a period of twelve months from date of shipment. Any product determined by the manufacturer to be defective will be replaced in whole or part as determined by the manufacturer, but no labor costs or other claims for damages will be allowed. Product must not be exposed to extreme temperatures. Products exposed to temperatures below 40 degrees Fahrenheit and above 105 degrees Fahrenheit shall be deemed non-warranty items. Products shall not be returned to Sandbox Marketing, Inc. without prior written authorization.

Returns and Refunds

No payments are refundable unless specifically provided for in contract for sale.

Limitation of Liability

In no event shall Sandbox Marketing, Inc. be liable for any direct, indirect, punitive, incidental, special consequential damages whatsoever arising out of or connected with the use or misuse of its products. You acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities recommend practicing social distancing. You further acknowledge that Sandbox Marketing, Inc. manufactures products aimed at reducing the spread of the Coronavirus/COVID-19. You further acknowledge that Sandbox Marketing, Inc. can not and does not guarantee that product users will not become infected with the Coronavirus/Covid-19. You understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of users and others even with reasonable use of Sandbox Marketing, Inc. products. You voluntarily seek products provided by Sandbox Marketing, Inc. and acknowledge that returning to a shared educational or workplace environment increases risk of exposure to the Coronavirus/COVID-19. You acknowledge that you will comply with all state, federal, and local procedures and recommendations to limit the spread of COVID-19. You hereby release and agree to hold Sandbox Marketing, Inc. harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of Sandbox Marketing, Inc., or that may otherwise arise in any way in connection with any services or products received from Sandbox Marketing, Inc. You understand that this release discharges Sandbox Marketing, Inc. from any liability or claim that you, or any representatives may have against Sandbox Marketing, Inc. with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any products or services received from Sandbox Marketing, Inc. This liability waiver and release extends to all owners, partners, and employees.

Other Statements

Sandbox Marketing, Inc. employees or representatives, ORALOR OTHER WRITTEN STATEMENTS, DO NOT CONSTITUTE WARRANTIES, shall not be relied upon by the buyer, and are not part of the contract for sale or this limited warranty. Sandbox Marketing, Inc. makes no representations about any of its products that are modified in any way after they leave its possession, nor do its representations apply when any of its products are improperly used or stored. Each customer of Sandbox Marketing, Inc. bears full responsibility for making its own determination as to the suitability of each material, product, recommendation or advice provided by Sandbox Marketing, Inc. Each customer of Sandbox Marketing, Inc. must identify and perform all tests and analyses necessary to assure that its finished parts incorporating materials from Sandbox Marketing, Inc. will be safe and suitable for use under end-use conditions. WARNING: This product can expose you to chemicals including Antimony trioxide, CAS 1309-64-4, which are known to the State of California to cause cancer. Entire Obligation

The TERM OF USE, WARRANTY AND DISCLAIMER document states the entire obligation of Sandbox Marketing, Inc. with respect to the products. If any part of this disclaimer is determined to be void, invalid, unenforceable or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effect.

General

This disclaimer statement is governed by the laws of the California, USA. You hereby consent to the exclusive jurisdiction and venue of the courts of competent jurisdiction, USA, in all disputes arising out of or relating to the use of this product. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.

Modification of Terms and Conditions

Sandbox Marketing, Inc. reserves the right to change the terms, conditions and notices under which their products are offered.
